1. Introduction

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). The DMCA provides a framework for copyright owners to protect their works online and establishes a 'safe harbor' for online service providers (OSPs) from liability for copyright infringement by their users, provided that they comply with certain requirements. 3. Safe Harbor Provision

The DMCA provides a safe harbor provision that protects online service providers from liability for copyright infringement committed by their users, provided that the service providers meet certain criteria. To qualify for this safe harbor, The Service must not have actual knowledge of infringing material, must not be aware of facts or circumstances that would make the infringing activity apparent, and must act expeditiously to remove or disable access to the infringing material upon receiving proper notification. Additionally, The Service must adopt and implement a policy for terminating the accounts of repeat infringers in appropriate circumstances.

4. Counter-Notice

A counter-notice must include the following information: (i) your physical or electronic signature; (ii) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled; (iii) a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification; and (iv) your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which The Service may be found, and that you will accept service of process from the person who provided the original notification of claimed infringement or an agent of such person.

5. Repeat Infringers

In accordance with the DMCA, The Service maintains a policy for the termination of accounts of users who are found to be repeat infringers. A repeat infringer is defined as a user who has been notified of infringing activity more than twice and has failed to take down the infringing material. The Service reserves the right to terminate the accounts of users who violate this policy in appropriate circumstances.
